1. Definitions

In these Terms and Conditions, the following terms have the meanings set out below:

  • "Trustmeadow", "we", "us", "our" refers to the business operating under that name at 26, Jalan Tun Jugah, 93350 Kuching, Sarawak, Malaysia.
  • "Service" or "Services" refers to any educational session, records organisation service, or programme offered by Trustmeadow, including the Meadow Orientation Session, Records Organisation Service, and Family Legacy Journey Programme.
  • "User" or "you" refers to any individual who visits our website, submits an enquiry, or engages our services.
  • "Website" refers to the website accessible at trustmee.live.
  • "Content" refers to all materials provided by Trustmeadow, including session content, glossaries, checklists, binders, and written resources.
  • "Agreement" refers to these Terms and Conditions together with any service booking confirmation.

2. Acceptance of Terms

By accessing our website or engaging any of our services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services.

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use our services. Our services are intended for adults making decisions about personal or family records.

3. Description of Services

Trustmeadow provides educational information sessions and practical records organisation services for individuals and families. Our services are educational and organisational in nature only. We do not provide legal advice, financial advice, estate planning advice, or any service requiring a professional licence. Nothing shared in any session or written material constitutes professional advice of any kind.

Services are primarily delivered in-person at our office in Kuching, Sarawak, or online via video call for clients elsewhere in Malaysia. Service delivery is subject to availability and mutual scheduling agreement.

4. Booking and Engagement

Services are confirmed upon receipt of a written booking confirmation from Trustmeadow and payment of the applicable fee. Bookings made via our website contact form are enquiries only and do not constitute a confirmed booking until confirmed in writing by us.

We reserve the right to decline any booking at our discretion, including where we believe the requested service falls outside our scope.

5. User Responsibilities

When using our services, you agree to:

  • Provide accurate and honest information when requested.
  • Use our services and materials for personal, non-commercial purposes only.
  • Not share, resell, or distribute any Trustmeadow materials without our written permission.
  • Seek advice from a qualified professional (solicitor, financial planner, or other licensed practitioner) for any personal legal, financial, or formal decisions — Trustmeadow cannot and does not provide such advice.
  • Treat our staff with courtesy and respect during all interactions.

6. Intellectual Property

All content produced by Trustmeadow — including session materials, glossaries, checklists, binders, guides, and website content — is the intellectual property of Trustmeadow and is protected under applicable Malaysian law.

You are granted a limited, non-exclusive, non-transferable licence to use the materials provided to you as part of your service for personal and family use only. You may not reproduce, distribute, or adapt these materials for any other purpose without our written consent.

7. Payment Terms

All fees are quoted and payable in Malaysian Ringgit (RM). Current service pricing is:

  • Meadow Orientation Session: RM 660
  • Records Organisation Service: RM 2,200
  • Family Legacy Journey Programme: RM 4,520

Payment is due prior to or at the first session, unless otherwise agreed in writing. We accept bank transfer and cash payment at our Kuching office. Receipts are issued for all payments.

Cancellation and Refunds

Cancellations made more than 5 business days before the first scheduled session will receive a full refund. Cancellations made within 5 business days of the first session, or after any session has commenced, are non-refundable. Where we cancel or reschedule a session at our initiative, a full refund or rescheduled appointment will be offered.

8. Service Scope and Limitations

Our services are educational and organisational only. We do not:

  • Draft, review, or advise on legal documents such as wills, trust deeds, or powers of attorney.
  • Provide financial planning, investment, or tax advice.
  • Act as a legal or financial representative of any kind.
  • Hold, store, or take custody of any client documents.
  • Make referrals to specific named professionals (we provide categories and bodies only).

The information we provide reflects general knowledge about how estate matters are typically handled in Malaysia. It is not interpreted or tailored as advice for your specific personal circumstances. We always encourage clients to consult the appropriate qualified professional for formal decisions.

9. Disclaimers

Our services and website content are provided in good faith and on an "as is" basis. While we take care to ensure the accuracy of general information provided, we make no representation that the information will be complete, current, or suitable for your specific situation.

We are not responsible for any decisions made by you or your family based on information or materials provided during our services. Formal legal and financial decisions should always be made with the guidance of a qualified professional.

10. Limitation of Liability

To the fullest extent permitted by Malaysian law, Trustmeadow's total liability to you for any claim arising from our services or these Terms shall not exceed the total fees paid by you for the specific service giving rise to the claim.

We shall not be liable for any indirect, consequential, or incidental loss, including loss of income, loss of data, or loss arising from reliance on information provided in our sessions or materials.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

11. Indemnification

You agree to indemnify and hold harmless Trustmeadow and its staff from any claims, damages, or expenses (including reasonable legal costs) arising from your breach of these Terms, your misuse of our services or materials, or any information you provide that is false or misleading.

12. Termination

Either party may terminate an ongoing service engagement by giving written notice. Where you terminate after a session has commenced, no refund will be provided for sessions already delivered. Where we terminate at our initiative without cause, a pro-rata refund of any prepaid fees will be provided.

Clauses relating to intellectual property, disclaimers, limitation of liability, and dispute resolution survive termination of this Agreement.

13. Dispute Resolution

These Terms are governed by the laws of Malaysia. In the event of any dispute arising from or in connection with our services, we encourage you to contact us in the first instance at [email protected] so that we may attempt to resolve the matter informally.

If informal resolution is not possible within 30 days, any dispute shall be referred to mediation before the Malaysian Mediation Centre, or to the courts of Malaysia, which shall have exclusive jurisdiction.

14. General Provisions

  • Entire Agreement: These Terms, together with any written booking confirmation, constitute the entire agreement between you and Trustmeadow in relation to our services.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
  • Waiver: Our failure to enforce any provision does not constitute a waiver of that right.
  • Assignment: You may not assign your rights under this Agreement without our written consent. We may assign our obligations to a successor entity.
  • Notices: Written notices may be sent by email to the addresses used in the booking correspondence.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. Continued use of our website or services after changes are posted constitutes your acceptance of the updated Terms. For ongoing service engagements, material changes will be communicated to you directly.
